1. Definitions and scope
1.1 In these terms, "we" or "us" means Van Beijck en SitGo B.V., trading under the names Van Beijck and Sitgo. "Customer" means anyone who orders from us. A consumer is a customer who is not acting for their trade or business. A dealer is a business customer.
1.2 These terms apply to all our offers and to every agreement with us, whether you order via the webshop, the dealer portal, by email or by phone.
1.3 Arrangements that differ from these terms only apply if we have confirmed them in writing (for example by email).
1.4 If a provision is unclear, we interpret it in the spirit of these terms. For a consumer, the interpretation most favourable to them always applies.
2. Offer and prices
2.1 Prices for consumers include VAT. Prices for dealers exclude VAT. You will see the shipping costs before you complete your order.
2.2 We do our best to show products, photos and specifications correctly. An obvious mistake or error in the offer or in a price is not binding on us.
3. The agreement
3.1 You go through the steps of the ordering process and check your details carefully. By ordering, you agree to these terms.
3.2 The agreement is concluded as soon as we have received your order and confirmed it by email.
3.3 You provide us with your correct and complete name, address and contact details. If anything changes, please let us know as soon as possible.
3.4 We may refuse or cancel an order for good reason, for example if details appear to be incorrect. In that case you will get back anything you have already paid.
4. Payment
4.1 Consumers pay when ordering, using one of the payment methods in the webshop.
4.2 Dealers pay on account, within the term stated on the invoice.
4.3 If you do not pay on time, you will first receive a payment reminder with a 14-day deadline. If you still do not pay, you are in default.
4.4 If the customer fails to meet their obligations, or goes bankrupt or is granted a suspension of payments, we may terminate the agreement with immediate effect.
5. Delivery, ownership and risk
5.1 Items in stock that are ordered on a working day before 4 pm are, in principle, shipped the same day. Other delivery times we mention are indicative.
5.2 A consumer will receive their order within 30 days at the latest, unless we agree otherwise. If this is not possible, the consumer may cancel the agreement free of charge. A missed delivery time does not otherwise entitle you to compensation.
5.3 Collection in Neede is possible on working days between 11 am and 4 pm.
5.4 The products remain our property until everything you owe us under the agreement has been paid in full.
5.5 The risk of loss or damage passes to the customer when the products are delivered to the customer (or to someone the customer has designated).
6. Right of withdrawal (cooling-off period)
6.1 As a consumer, you may cancel the agreement within 14 days of receiving the product without giving any reason.
6.2 Let us know by email within those 14 days. Then return the product within 14 days.
6.3 Return the product complete and undamaged, in its original packaging where possible. You may only inspect and try the product as you would in a shop. If the product has already been fitted or used, we may charge for the loss in value.
6.4 The cost of returning the product is yours. We will refund the purchase price, including the standard delivery costs, within 14 days of your notice of cancellation. We may withhold the refund until we have received the product.
6.5 The right of withdrawal does not apply to products we have made specially to your specifications, such as a motor we spoke into your rim to order, nor to a refurbishment that has already been carried out.
6.6 The right of withdrawal only applies to consumers, not to dealers.
7. Complaints
7.1 Check the products immediately on receipt. If something is wrong, let us know as soon as possible after you discover it, by email with a short explanation and a photo if possible.
7.2 If a product does not meet what you could reasonably expect, we will replace or repair it, or refund the invoice amount.
8. Warranty
8.1 Our products meet what you may reasonably expect in terms of usability, reliability and service life.
8.2 We give a 2-year warranty on all products from the invoice date, unless expressly stated otherwise. Your statutory rights always continue to apply as well.
8.3 Send a product in for warranty together with the repair or warranty form. You pay the shipping costs first; if the warranty claim is valid, we will refund them. A consumer pays no administration or return costs for a valid claim.
8.4 The warranty does not apply:
- in case of damage caused by drops, water or incorrect use or maintenance (see article 10);
- if parts have been opened, repaired or modified without our permission;
- in case of normal battery wear: a capacity loss of 20% or less per year is normal;
- in case of deep discharge of the battery because it was not charged for too long;
- if the original invoice is missing or has been altered.
8.5 If you bought as a consumer through a dealer, report a warranty claim to that dealer.
8.6 The warranty only applies to the first buyer and is not transferable. If the first buyer sells the product on to someone else, the warranty lapses. This does not apply to a dealer selling the product to a consumer: that consumer is then the first buyer and is fully covered by the warranty.
9. Liability
9.1 We are only liable for damage resulting from intent or gross negligence on our part.
9.2 Our liability is always limited to the invoice amount of the product or service that caused the damage. We are not liable for consequential or business loss.
9.3 These limitations do not apply insofar as the law does not permit them, for example towards a consumer.
10. Installation, use and maintenance
10.1 Fit the products properly and according to our instructions. If in doubt, have a bike shop do the installation. Damage caused by incorrect installation is not covered by the warranty.
10.2 About 4 weeks after installation, retighten all bolts and nuts and have the spoke tension checked. Spokes settle in the first weeks; a spoke that is too loose may break later.
10.3 On public roads, an e-bike may provide assistance up to a maximum of 25 km/h. You are responsible for complying with the traffic rules.
10.4 Protect the parts against water, for example by not using a pressure washer, covering the bike properly when carried on a car, and fitting the cables correctly.
11. Returning batteries
11.1 Strict fire-safety and transport rules apply to lithium-ion batteries. Therefore, when returning a battery:
- a battery with drop or water damage may no longer be shipped;
- the battery is charged to less than 50%, preferably as empty as possible;
- the battery is packed very firmly and safely; if the packaging is inadequate, we will refuse the parcel;
- you check in advance with the carrier about their conditions for shipping lithium-ion batteries;
- you always include the repair or warranty form.
11.2 If inspection shows that a battery does have drop or water damage, we will dismantle and destroy it immediately for safety reasons.
12. Battery refurbishment
12.1 A battery refurbishment (for example of a Van Raam battery) is not ordered online. You send your battery, the charger and the completed repair form to us, in accordance with article 11.
12.2 After the refurbishment you will receive the invoice. Once it has been paid, we will return the battery.
13. Reviews
13.1 We read every review before we publish it. We do not publish reviews with offensive, untrue or promotional content. We never show your email address.
14. Force majeure
14.1 In the event of force majeure, we do not have to meet our obligations for as long as it lasts. Force majeure includes any circumstance beyond our control that prevents performance, such as a strike, fire, business disruption, failure of communication networks or late delivery by a supplier.
15. Personal data
15.1 We only use your data to process your order, to keep you informed about your order, for service and aftercare, and for our administration. We never sell your data to others. Read more in our privacy statement.
16. Applicable law
16.1 All agreements are governed by Dutch law.
16.2 Disputes will be submitted to the competent court in the Netherlands. A consumer retains the protection afforded by the law of their own country.
